Terms of Service

These terms cover your use of Cited This Week (the "Service"), a product of Ultimoment, based in Texas ("we," "us"). By subscribing, you agree to these terms.
1. What the Service is
Each week we email subscribers a list of restaurants and other food establishments that were cited for pest-related violations in publicly available health inspection reports for the areas the subscriber chooses. The list may include the establishment's name, address, inspection date, the inspector's comments, and contact details when they appear in the public record.
2. Accounts and subscriptions
- The Service is for businesses, not personal or household use.
- Subscriptions are billed monthly in advance through our payment processor, Stripe, at the price shown when you subscribe, plus any applicable sales tax.
- Your subscription renews automatically each month until you cancel.
- Promotional prices (such as a founding rate) apply for the period stated at sign-up. After that period, the then-current price applies, and we will email you before any price change takes effect.
3. Cancellation and refunds
You can cancel at any time; cancellation takes effect at the end of the current billing period. New subscribers may request a full refund of their first payment within 30 days. See our Refund & Cancellation Policy.
4. About the data
- Lists are compiled from public records published by government health departments. We do not control those records and cannot guarantee that they are complete, accurate, or current, or that every citation in an area will appear in a list.
- Inspection results reflect conditions at the time of inspection. A citation does not mean a problem still exists, and establishments may have corrected issues since.
- We do not guarantee any particular number of listings or any business results, such as new customers or revenue.
5. How you may use the lists
- You may use the lists for your own business's sales and marketing.
- You may not resell, republish, or redistribute the lists, or share them outside your company.
- You are responsible for following the laws that apply to how you contact businesses (including laws on telemarketing, commercial email, and solicitation), and for treating listed businesses professionally. Do not misrepresent yourself as a health department or government official, and do not use the lists to harass, threaten, or publicly shame any business.
6. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and accuracy, to the fullest extent permitted by law.
7. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or lost-profit damages arising from your use of the Service, and our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.
8. Changes and termination
We may update the Service or these terms. If we make a material change, we will email subscribers before it takes effect. We may suspend or end a subscription that violates these terms, with a pro-rated refund for any unused prepaid period if we end it without cause.
9. Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.
